Agreement to Terms
By accessing or using the website at experienceflows.ai or engaging Experience Flows ("we," "us," or "our") for services, you agree to be bound by these Terms of Service. If you do not agree, do not use our website or services.
Services Overview
Experience Flows provides subscription-based website design, development, management, and support services for businesses. Our services are delivered under monthly subscription plans (Launch, Growth, and Premium) as described on our pricing page. Each plan includes a defined scope of work, content update allowance, and support response time.
Subscriptions and Billing
- Monthly billing: All plans are billed monthly. Your subscription renews automatically on the same date each month until cancelled.
- Setup fees: Each plan requires a one-time setup fee that covers planning, design, build, and launch. Setup fees are non-refundable once work has begun.
- Price changes: We may adjust plan pricing with 30 days' written notice. You may cancel before the new price takes effect.
- Payment: Payment is due at the start of each billing cycle. If payment fails, we will attempt to notify you. Continued non-payment may result in service suspension.
Cancellation
- You may cancel your subscription at any time with 30 days' written notice.
- Your service will remain active through the end of your current billing period.
- Upon cancellation, we will provide your website files and content in a standard format upon request.
- Setup fees are non-refundable. Monthly fees are non-refundable for the current billing period.
Scope of Work and Overages
- Growth and Premium include unlimited self-serve content edits made by you in the portal.
- Each plan includes a set number of EF-managed updates per quarter as described on the pricing page; unused allowances do not roll over.
- A small content update is one objective on one existing page, completed in up to 20 minutes.
- Larger work — such as new pages, redesigns, advanced integrations, or additional updates beyond your included scope — is always quoted and approved by you before we begin.
- Standard out-of-scope work begins at $135 per hour or as a fixed add-on.
Intellectual Property
- Your content: You retain ownership of all text, images, logos, and other content you provide to us.
- Our work: Upon full payment, you receive a license to use the website design and code we create for you. Custom code and design work become yours upon delivery and full payment.
- Third-party tools: Your website may use third-party software, plugins, or services that are subject to their own license terms.
- Our brand: The Experience Flows name, logo, and website content remain our property. You may not reproduce or redistribute them.
Your Responsibilities
- Provide accurate and timely content, feedback, and approvals needed to complete your project
- Ensure that content you provide does not infringe on third-party intellectual property rights
- Keep your account credentials secure
- Comply with all applicable laws regarding your website content and business operations
Visitor Data We Process for You
When visitors to a website we host for you submit information through that website (such as contact-form leads), that information belongs to you, and we act as your service provider, processing it only to deliver the services. Specifically, we:
- Process visitor information solely to operate, store, deliver, and back up your website and its leads — never for our own marketing, advertising, or profiling
- Do not sell, share, rent, or trade visitor information, including as "sell" and "share" are defined by the California Consumer Privacy Act (CCPA)
- Use vetted subprocessors to deliver the services — currently Vercel (hosting), Supabase (data storage), Resend (email delivery), PostHog (product analytics), and Upstash (abuse prevention)
- Retain visitor leads for up to twelve months from submission (or ninety days after you archive them), after which they are deleted automatically; you may request earlier deletion at any time
- Delete or return your visitor data when your services end, except where the law requires us to keep it
- Notify you without undue delay if we become aware of a security incident affecting your visitor data
You are responsible for publishing a privacy policy on your website that accurately describes how visitor information is collected and used, and for honoring privacy requests from your visitors. Our platform includes a legal-page feature to help you publish these documents.
Service Availability
We aim to keep your website available 24/7, but we do not guarantee uninterrupted service. Scheduled maintenance, hosting provider outages, and circumstances beyond our control may cause temporary downtime. We are not liable for losses resulting from service interruptions.
Limitation of Liability
To the maximum extent permitted by law, Experience Flows shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from these terms or our services shall not exceed the total amount you paid us in the 3 months preceding the claim.
Disclaimer
Our services are provided "as is" and "as available." While we strive for quality and reliability, we do not warrant that our services will meet every specific requirement, achieve particular results, or be error-free at all times.
Changes to These Terms
We may update these Terms of Service from time to time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the updated terms. For material changes, we will provide 30 days' notice.
Governing Law
These terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or our services shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
